10 Jul 11 LabCorp and Supervisor Charged With Discrimination

Discrimination at LabCorpLabCorp is being sued for allegedly violating the civil rights of an employee who complained about a supervisor’s racial remarks.

James Litomisky filed suit against Laboratory Corp. of America on June 27 in federal court of New Orleans. In the lawsuit, Litomisky argues he was terminated from his employment with LabCorp in retaliation for his objecting to, opposing, and refusing to cooperate with LabCorp’s discrimination against its employees with respect to the terms and conditions of their employment on the basis of their race.

Specifically, Litomisky alleges his supervisor made racist remarks regarding African American LabCorp employees. He objected to this language and complained to the human resource department. He was told the employees who were the butt of the racial comments must file complaints in writing on the proper forms for any action to be taken.

Less than a month later, he was placed on a performance improvement plan, allegedly in retaliation for his complaints about the discriminatory behavior. Litomisky also argues that his supervisor directed him to falsify quarterly performance management reviews of two African-American employees so that his supervisor could terminate them. Initially, he complied with the directive, but the next day he informed human resources of the incident and corrected the reviews. He was terminated from his position in October 2010, the lawsuit says.

The defendant is accused of violating the Louisiana Human Rights Act and the Louisiana Whistleblower Act. The plaintiff is seeking damages for back pay, reinstatement or in lieu of reinstatement, front pay, compensatory damages including medical expenses, pecuniary damages, damages for emotional distress, lost wages and benefits, punitive damages and attorney’s fees.

    I am a FORMER employee of Labcorp..and yes they allow the suervisors to talk and treat you any way they want to..and complaining dosnt do any good because your complaing to deaf ears…I worked for this company for 5 years…I put up with ALOT of crap from supervisors and coworkers and when I was called into a meeting with a coworker and my supervisor about how I spoke to this coworker…when I tried to explain the reason I spoke to this coworker in the manner I did was because she called me a “White Bitch”…the supervisor(NINA PIERCE) laughed and told the employee that said it..you cant call her a white bitch on the clock… I knew i was time to leave this company… tried to transfer..but even though you let the human resource department know that there is issues and request to be moved…they say we are not doing any internal transfers we are only hirig off the street. I am sooooooooo glad to not work for this company anymore. I feel bad for the patients who are forced to use them. Labcorp does ave SOME good employees who care about taking the time to ensure your lab tests are drawn correctly and sent out correctly and that try to limit your wait time by actually working but manageent is slowly weeding out these people by either firing them or treating them so bad that they quit…LABCORP does truly suck..and the only regret I have working for this company is that I wasted 5 years of my time and skills for a company that was NEVER worthy of ME to be an employee at!!!! So if your lazy, slow moving, love to make people wait while you and your coworkers talk or your on your cell phone, and you dont care what tubes you draw their blood in or even care if you send it out it correctly or how many sticks it takes to get the blood…Good News…..LABCORP WANTS YOU…TO BE A EMPLOYEE!!!!! LABCORP SUCKS!!!!!

    Pamela Mason is the worst manager ever….I’ve even heard that an employee hung herself b/c of her relentless acts…in the past few months, I’ve made myself sick b/c of her patheticness….poor management, manages by fear and intimadation…doesn’t answer phone or emails….shes a C))T…you know what I mean.

    There are many complaints about employees in LabCorp locations throughout the country mistreating patients. Deb sent me an email about her unfortunate encouter in LabCorp’s Arlington Virginia Location. What one would expect to be a 5 minute event turned into an hour ordeal. Why? Just because they can. Management in these LabCorp locations does not seem to care about patient satisfaction. After all, LabCorp is the low-price leader to HMOs and insurance companies. Who needs to treat people with the respect that they deserve when you get them through pricing practices. While I find Laboratory Corporation of America employees who treat patients this way revolting, it’s really managements fault. The supervisors do not seem to care and just push for production. Patients will complain as Deb did about the Arlington VA location, but management does nothing about it.

    Soon to be X-employee I work in the Denver area and it is the worst management that I’ve work under.I was going through a tough period in my life and needed to take some time off for my ill daughter and going through a divorce on top of that. My manager tells me that I should quit and go on Medicaid. I’ve been with LabCorp for five years, which qualifies me to file for FMLA. In doing so my care providers did not turn in the paper work in a timely matter, so I had to file an appeal. During this time my daughter passed and I seek a grief counselor. When I contacted my manager to let her know she stated to me to have a return to work letter and proof of death. How soulless could she be. I’ve seek an attorney and also contacted EEOC about what I’m going through. I will never recommend this company for employment or lab analysis for care providers.
